I had looked at the bottom of the site which is Attribution-ShareAlike (BY-SA) and links to the BY-SA license, which allows commercial use as long as the new work is based on the same license. The top says no non-commercial use but doesn't link to a license.

While he obviously has the right under current copyright law to offer it on his own terms, this isn't taking part in free culture if you try to restrict the creativity and rights of others to build on your work. (Which was built on the work of others and so on.)

I disagree about the coolness of possible reuse for profit. That new work would be likewise free for reuse and profit by others, assuming proper attribution and maintenance of the free terms, and that would help contribute to a healthy public domain for further works to be created. (Although public domain is different than CC, of course.)

The commercial/non-commercial distinction is thin at best. Your site here is commercial because of ads and Amazon affiliate links. While your use might be fair use, do you want to worry about petty distinctions of what commercial really means?

I know this is extreme for some people, but I really believe that once the bits are published, then they should be free for copying and reuse under the free terms. The bits are non-scarce. New business models will be needed for people to make money on their creative work. Since time and attention are still scarce, there will be ways. For example, paying for the work up front. Trey's work appears to be extremely popular -- I bet he could make money even if he did offer it under truly free terms.

Scott, you are such a purist...
